Governor Lujan Grisham has signed the three major money bills for the session, House Bill 2, the General Appropriations Act, Senate Bill 192, Additional Appropriations and Confidentiality and HB 505, Capital Outlay Projects.
House Bill 2, the General Appropriations Act
HB 2 enacted the original budget funding recommended for the New Mexico State Library, and added $200,000 for the National History Day program, which had been in SB 270.
The Governor vetoed language in HB 2 specifying tribal education department participation in the Indian education fund. The vetoed language had listed tribal libraries. Her veto message says: "On page 186, line 9, I have vetoed from the word "to" through the end of the line, and on line 10, I have vetoed from the beginning of the line through the word "schools". The vetoed language is unnecessary because existing law already defines eligible recipients."
Section 4. FISCAL YEAR 2024 APPROPRIATIONS. K. PUBLIC SCHOOL SUPPORT. (5) Indian education fund:
The secretary of public education, in collaboration with the assistant secretary for Indian education, shall develop a methodology to allocate the twenty million dollar ($20,000,000) general fund appropriation to tribal education departments, tribal libraries, Native American language programs, school districts and charter schools based on operational needs and student enrollment for expenditure in fiscal year 2024 and fiscal year 2025.
House Bill 2 appropriated $15 million for the Rural Libraries Endowment fund, and specified that the money "is from the general fund and not the appropriation contingency fund of the general fund." This brings the endowment fund up to $28 million. Senator Jerry Ortiz y Pino had sponsored a bill, SB 214, which would have appropriated $37 million. Senator Ortiz y Pino plans to work for a 2024 appropriation to reach the goal of having $50 million in the endowment fund.
Senate Bill 192, Additional Appropriations and Confidentiality
This is the bill that is often called the "Junior Bill." It is where appropriations which did not get included in the General Appropriations Act (HB 2) or the Capital Outlay Projects bill (HB 505) get funded. Eight library project appropriations were included in SB 192. The Governor included seven of these projects in her approval of the bill, and vetoed one project.
The seven funded projects are:
Seventy-five thousand dollars ($75,000) for services and food distribution at El Valle community center and for the Villanueva library. This appropriation reflects the request for funding this library in SB 258, which was tabled in the Senate Finance Committee.
One hundred thousand dollars ($100,000) for programming, equipment or materials at the Placitas community library;
Eighty-five thousand dollars ($85,000) to purchase a library sorter for Rio Rancho;
One hundred thousand dollars ($100,000) for programming, equipment and materials at the Edgewood community library;
One hundred thousand dollars ($100,000) for programming, equipment and materials at the Vista Grande public library;
One hundred thousand dollars ($100,000) for library services in four communities in Lincoln county; (Carrizozo, Ruidoso, Corona, Capitan)
To the board of regents of New Mexico highlands university, one hundred sixty-five thousand dollars ($165,000) is appropriated to purchase learning materials and related equipment for the Thomas C. Donnelly library and the athletic department.
The one project in SB 192 that the Governor vetoed is:
One hundred fifty thousand dollars ($150,000) for improvements for the library, jail and rodeo grounds in Magdalena;
HB 505, Capital Outlay Projects
The Governor signed HB 505, which provided $1,234,519,983 for over 1,500 projects statewide. She line-item vetoed only three of these projects. All twenty-nine library-related projects were approved, appropriating $28,513,780. The largest item was a $20 million appropriation "to plan, design, construct, renovate, furnish and equip tribal libraries statewide, including for facilities in the Pueblo of Jemez, the Pueblo of Santa Clara, the Pueblo of Santo Domingo and the Mescalero Apache Nation, with award amounts to be determined by the department based on submission of cost estimates from a qualified professional and documentation of readiness to proceed."
A spreadsheet is attached which shows the library projects approved in HB 505.
SB 147, Tax Changes
The Governor signed the tax bill making many technical corrections to the tax code. SB 147 includes provision to exempt governments from paying gross receipts tax for "digital products" that are loaned to the public.
The effort by NMLA to support a $350,000 appropriation for a new bookmobile for the New Mexico State Library was unsuccessful.
