FLOOR ACTIONS

HB 2, the General Appropriations Act

The House concurred with Senate amendments to HB 2, the General Appropriations Act, by a voice vote. The Senate had amended the bill to add $130 million in additional appropriations. By accepting the Senate’s changes, the HB 2 budget now goes to the Governor for her signature.

HB 2 continues to include the original budget funding for the New Mexico State Library and the following additional provisions relating to libraries:

Section 4. FISCAL YEAR 2024 APPROPRIATIONS.
K. PUBLIC SCHOOL SUPPORT
(5) Indian education fund:
Appropriations:
(a) Other 20,000.0 20,000.0
The secretary of public education, in collaboration with the assistant secretary for Indian education, shall develop a methodology to allocate the twenty million dollar ($20,000,000) general fund appropriation to tribal education departments, tribal libraries, Native American language programs,
school districts and charter schools based on operational needs and student enrollment.

Section 5. SPECIAL APPROPRIATIONS. --The following amounts are appropriated from the general fund or other funds as indicated for the purposes specified.

(86) CULTURAL AFFAIRS DEPARTMENT 15,000.0 15,000.0
For the rural libraries endowment fund. [$15 million]

Section 10. FUND TRANSFERS.-The following amounts are transferred in fiscal year 2024 from the general fund or other funds as indicated for the purposes specified.

(7) RURAL LIBRARY ENDOWMENT FUND
The transfer to the rural library endowment fund contained in Subsection 2 of Section 11 of Chapter 54 of Laws 2022 is from the general fund and not the appropriation contingency fund of the general fund.

Section 13. CERTAIN FISCAL YEAR 2024 BUDGET ADJUSTMENTS AUTHORIZED.
(30) the cultural affairs department may request budget increases up to seven hundred fifty thousand dollars ($750,000) from other state funds from the cultural affairs department enterprise fund, the museum and historic sites program of the cultural affairs department may request budget increases up to one million dollars ($1,000,000) from other state funds, the library services program of the cultural affairs department may request budget increases from other state funds in the rural libraries program fund for rural library grants and the preservation program of the cultural affairs department may request budget increases up to five hundred thousand dollars ($500,000) from other state funds for archaeological services or historic preservation services;

SB 147, Tax Changes

This large bill includes provision to exempt governments from paying gross receipts tax for “digital products” that are loaned to the public. It was heard by the House Taxation and Revenue Committee on March 8th. The webcast is at:

The bill summary begins at 10:17:30 am. The digital products section is mentioned at 10:24:45. Public comment begins at 10:27:30. The committee gave a unanimous do-pass recommendation at 10:29:30.

Rep. Harper presents the bill beginning at 1:30 pm. At 1:35:50, he notes the digital products section. Voting begins at 1:38. The bill passes by a vote of 59 – 0. SB 147 now goes to the Governor for her signature.


HB 505, Capital Outlay Projects

On Saturday, March 11th, the full House debated and passed HB 505 with some minor amendments, by a vote of 39 to 26. Rep. Lente again mentioned the tribal library construction funding in his summary of the bill.

Consideration of HB 505 begins at 3:15 pm. The vote begins at 5:13:45 pm.

Today, the full Senate debated and passed HB 505 by a vote of 27 to 13.

The bill is presented at 3:05:30 pm. The bill totals $2.2 billion, with 2,888 individual projects. An amendment to delete the proposed reproductive health facility failed. Debate on the full bill resumes at 3:42. The vote begins at 4:07. The bill passed by a vote of 27-13. HB 505 now goes to the Governor for her signature. The Governor can line-item-veto any project in the bill.

HOUSE FLOOR STATUS

House Bill 147, Indian Education Funds Distribution

HB 147 is on the Thursday, March 16th House agenda. It is the fifth item on the “Third Reading of Legislation” calendar.  This allows tribal education entities including tribal libraries to retain funds granted for programs.

Senate Bill 270, National History Day Program Schools

SB 270 was awaiting a hearing in the House Appropriations and Finance Committee. The State Library would receive $200,000 to contract with the New Mexico Endowment for the Humanities to conduct this program in schools. Instead, the Senate Finance Committee included this funding in the HB 2/3 General Appropriations Act. The Senate passed HB 2/3 as amended, and today the House concurred with the amended bill.


COMMITTEE HEARING

Senate Finance Committee Substitute For Senate Bill 192, Additional Appropriations and Confidentiality

This is the bill that is often called the “Junior Bill.”  It is where appropriations which did not get included in the General Appropriations Act (HB 2) or the Capital Outlay Projects bill (SB 505) get funded. Eight library project appropriations are included in this 46 page bill. Senate Bill 192 passed the Senate on February 22nd on a 35-0 vote.

Today, the House Appropriations and Finance Committee heard and made major additions to SB 192. The webcast is at

Discussion begins with the adoption of amendments at 3:59 pm. Discussion of the amended bill begins at 4:05. At 4:12, the Committee gives the bill a do-pass recommendation by a vote of 14-0. The bill now goes to the House floor. Once it passes the House, the Senate will need to concur with the House amendments.


Here are the library projects in SB 192 and legislators who put in capital outlay project requests for them.

SECTION 3. GENERAL CONTROL FISCAL YEAR 2023 APPROPRIATIONS.
B. to the local government division of the department of finance and administration,

(22) in San Miguel county:
(b) seventy-five thousand dollars ($75,000)
for services and food distribution at El Valle community center and
for the Villanueva library;
Representatives Patricia Roybal Caballero, Joseph Sanchez, Martin R. Zamora and Ambrose Castellano and Senators Pete Campos and Elizabeth "Liz" Stefanics included this project in their capital outlay requests.

(23) in Sandoval county:
(i) one hundred thousand dollars ($100,000) for programming, equipment or materials at the Placitas community library;

This project was not in any legislator’s capital outlay request.

(o) eighty-five thousand dollars ($85,000) to purchase a library sorter for Rio Rancho;

Representatives Alan T. Martinez, Kathleen Cates, Jason C. Harper and Joshua N. Hernandez and Senator Brenda G. McKenna included this project in their capital outlay requests.

(24) in Santa Fe county:
(a) one hundred thousand dollars ($100,000)
for programming, equipment and materials at the Edgewood community
library;

This project was not in any legislator’s capital outlay request.


(d) one hundred thousand dollars ($100,000)
for programming, equipment and materials at the Vista Grande public
library;

This project was not in any legislator’s capital outlay request.

(26) in Socorro county:
(a) one hundred fifty thousand dollars
($150,000) for improvements for the library, jail and rodeo grounds in Magdalena;

Representatives Tara Jaramillo and Gail Armstrong and Senators Gregory A. Baca, Crystal R. Diamond and Siah Correa Hemphill included this project in their capital outlay requests.

SECTION 5. AGRICULTURE, ENERGY AND NATURAL RESOURCES
FISCAL YEAR 2023 APPROPRIATIONS
A.  to the cultural affairs department,
(13) one hundred thousand dollars ($100,000) for library services in four communities in Lincoln county;

This appropriation likely was initiated by Senator Liz Stefanics. She had made capital outlay requests for the public libraries in her district in 2020, 2021 and 2022. The four public libraries in Lincoln County are Capitan, Carrizozo, Corona and Ruidoso.

SECTION 9. HIGHER EDUCATION FISCAL YEAR 2023
APPROPRIATIONS
D. to the board of regents of New Mexico highlands university, one hundred sixty-five thousand dollars ($165,000) is appropriated to purchase learning materials and related equipment for the Thomas C. Donnelly library and the athletic department.

Senator Pete Campos included the athletic department portion of this appropriation in his capital outlay requests, but the Donnelly Library portion was not in any legislator’s request.
