Required by the Broadband DATA Act of 2020, the new map displays location level information on broadband availability throughout the country and allows individuals to search for their address, as well as review and dispute services at their location. For providers, the release of the first map comes alongside efforts already underway for submitting challenges of and corrections to the underlying ?fabric? of locations that can be served by broadband providers. The commission has stressed that this pre-production draft of the map is far from final. ? The accuracy of the maps and documenting the need will ultimately determine future funding. Following the fabric and coverage data challenge processes, an updated version of the FCC map will be used to determine the allocation of $42.5 billion in Broadband Equity, Access, and Deployment (BEAD) Program funds to each state and territory, as well as determining eligibility of areas for funding under various programs. The map, particularly after the challenge processes are implemented, aims to be the most comprehensive collection of broadband data to date. The TBCP, part of President Biden?s Internet for All initiative, offers grants to eligible Native American, Alaska Native, and Native Hawaiian entities for high-speed internet deployment, digital inclusion, workforce development, telehealth, and distance learning. The Picuris Pueblo Indian Tribe was awarded $3,742,991.00. The Broadband Infrastructure Deployment project proposes to install fiber directly connecting 79 unserved Native American households, 15 Tribal offices, 2 Tribal businesses, and 3 community anchor institutions with qualifying broadband service with up to 1Gbps symmetrical speeds. Pueblo of Santa Clara was awarded $9,175,946.00. The Broadband Infrastructure Deployment project proposes to install fiber directly connecting 600 unserved Native American households with fiber to the home service of 1 Gbps symmetrical and 50/10 Mbps wireless service. The 2023 Legislative session started today, Tuesday, January 17th. This will be a 60-day session, ending at noon on Saturday, March 18th. February 16th is the last day for new bills to be introduced. NMLA Legislative Day will be Friday, January 27. Please ask library supporters, including your local board members and friends? groups to save the date and plan to be there. We are putting together a legislative briefing from 8:30 to 9:30 am to review library legislative prospects. Rural Library Endowment Fund The Governor?s budget includes an additional $15 million appropriation to the endowment fund, which would bring it to $28 million. The Legislative Finance Committee proposed budget also requests $15 million. Senator Ortiz y Pino has indicated that he is seeking support to appropriate $37 million, which would bring the fund to the $50 million originally envisioned to provide sufficient revenue to qualifying libraries to insure ongoing financial stability. Tribal Libraries There will be continued efforts by the Tribal Education Alliance (TEA) to address education inequities identified in the Yazzie/Martinez case. Their main proposal is to establish a Tribal Education Trust Fund, which could provide consistent and stable funding for tribal community-based education, including for staffing and operating tribal libraries, into perpetuity. Representative Susan K. Herrera is the co-sponsor in the House. The bill is awaiting a hearing in the Senate Indian, Rural and Cultural Affairs Committee. The text is below. San Miguel County Rural Libraries On January 26th, Senators Liz Stefanics, Senator Pete Campos and Representative Ambrose Castellano introduced SB 258, appropriating $42,000 for rural library services in San Miguel County. The text is below. COMMITTEE HEARINGS Tribal Libraries The House Education Committee heard two of Rep. Derrick Lente?s Tribal Education Initiative (TEA) bills on January 27th. HB 140 creates a Tribal Education Trust Fund, appropriating $50 million to establish the fund. Proceeds from the fund would be allocated directly to tribal education departments, bypassing the current method of having the Public Education Department reimburse tribes for educational expenditures they make under the Indian Education Act. HB 147 creates a tribal education fund in the State Treasury to handle Tribal Education Trust Fund money. The objective is to ensure that tribes receive stable and consistent funding to carry out tribally based education programs. Such funding would not revert to the state. Several librarians and library supporters spoke in favor of these two bills. Lillian Chavez, Mescalero Community Librarian, speaks at 10:29:50. Lillian describes the community benefits that resulted from state investments in library programs at Mescalero. Alana McGrattan, retired Santa Fe Indian School librarian and retired State Library Tribal Libraries Coordinator begins at 10:32:30. Alana describes the educational benefits of putting control of the funding into the hands of tribal communities, as exemplified by the effectiveness of the Santa Fe Indian School. Valarie Bellson, Zuni Public Library, begins at 10:33:40. Valarie said that the legislation will enable civic engagement for the people of the community, so that students can grow up to be leaders. Tracey Charlie, Acoma Learning Center, 10:42:00, supports the bill. The Committee gives the bill a unanimous do-pass recommendation at 11:53:00 Discussion of HB 147 begins at 10:54:00. An Isleta Pueblo tribal official whose name is inaudible starts at 10:56:15. He speaks to the fact that the Isleta Public Library is open to all the public, not just tribal members. Nambe Tribal Library Coordinator (Tracy Hill?) begins at 10:58:15. She describes the difficulty of starting a new library when the granted funds must be spent by the end of the fiscal year. She supports allowing tribes to be able to roll over the funds so that they can be spent effectively. A San Felipe Pueblo official (name inaudible) speaks at 11:58:00. He states that the San Felipe Library is also open to the entire community. Lillian Chavez, at 11:59:00 states that the Mescalero Apache Tribe also supports HB 147. She has a situation comparable to the one described at Nambe, where a large allocation from the 2022 legislature for library programs has just arrived, and she must spend those funds by the end of this fiscal year. A school official from Cuba noted that children on the Eastern Navajo reservation lacked access to libraries and other services. James Naranjo, Lt. Governor of Santa Clara Pueblo recalled the benefits he gained using the library at the Santa Fe Indian School, at 11:04:20. A Lt. Governor of Laguna Pueblo mentions libraries at 11:10:00. George Chandler and Paula Couselo-Findikoglu will present information on legal resources for low income persons and for people of limited English proficiency, low literacy, or disabilities. George Chandler will be presenting an overview of a guide to legal resources available online for individuals who want to help low income persons in parts of the state with limited resources find assistance with legal problems. George retired from a career as a physicist at Los Alamos National laboratory in 2001, and attended Law School at the University of New Mexico. In his 18 years as a lawyer he practiced water and family law, and became a poverty lawyer, representing many low-income persons at no or low fees. He served as a member of the Access to Justice Commission for 8 years, and continues to volunteer on several ATJ committees, including the Community Engagement Team that sponsors civil legal webinars. Paula Couselo-Findikoglu will provide an overview of the "Clara" self-service kiosks and scribing services initiatives. These initiatives intend to improve court access for self-represented litigants with Limited-English Proficiency, low literacy and people with disabilities. "Clara" relies on text to speech, speech to text, voice recognition and AI technology to provide assistance to the public. Clara is an engaging avatar with a built-in friendly personality, who relies on Natural Language Processing (NLP) and human interaction to build her knowledge base. Scribing services assist self-represented litigants who are unable to read or complete court forms because they have low literacy, a limited ability to read or write in English, or a disability that prevents them from independently filling out a form. Trained court employees or volunteers provide the service. The session will include video demonstrations of both programs and a Q&A session. Paula serves as the Court Services Deputy Division Director at the NM Administrative Office of the Courts. She served as the Language Access Senior Statewide Program Manager until 2021. Ms. Couselo-Findikoglu is an ex officio member in the NM Judiciary of the NM Supreme Court's Equity and Justice Commission, and created the Diversity and Inclusion Department within the Court Services Division of the NM Administrative Office of the Courts in 2021. She Co-Chairs NASJE's Diversity, Fairness and Access Committee, and serves as an NCSC's Council of Language Access Coordinators liaison to COSCA's National Language Access Advisory Committee. The 2020 Access to Justice Index, published by the National Center for Access to Justice, ranked the NM Judiciary's Language Access Program under her direction #1 in the nation. Ms. Couselo-Findikoglu is a nationally recognized expert in the language access field, and has spearheaded multiple initiatives and technologies to advance court access for LEP and low literacy individuals, and people with disabilities interacting with the NM State Courts.
