BILLS INTRODUCED
Senate Joint Resolution 9, Anti-Donation Clause Constitutional Amendment, is sponsored by Senators Jerry Ortiz y Pino and George Muñoz. It asks voters to modify the Anti-Donation Clause of the New Mexico Constitution to allow state government to provide direct funding to organizations not presently eligible to receive them. Among these organizations could be non- profit 501(c) (3) rural libraries in unincorporated areas.
The Fiscal Impact Report says “Should the constitution be amended, SJR9 could lead to large transfers of public funds—by both the state and local public bodies—to private organizations and individuals, outside and not subject to traditional rules of contract and government procurement that ordinarily constrain the transfer of public money to private entities.” If voters adopt the amendment, the Legislature will have to pass enabling legislation specifying requirements for eligibility and oversight. SJR 9 was scheduled to be heard in the Senate Rules Committee today, but the Committee had to adjourn before they got to it. COMMITTEE HEARINGS
Rural Libraries Endowment Fund. Senate Bill 214 appropriates $37 million to the fund. The bill is scheduled to be heard by the Senate Finance Committee tomorrow morning. It is fourth on the agenda. There is a major bill ahead of it, and committees sometimes are not able to hear all of the bills on their agenda. If it is not heard, then it could be heard on Friday afternoon, after the Senate Floor Session. Supporters should be prepared to testify when it comes up.

CAPITAL OUTLAY PROJECTS
The list of capital outlay requests has just been released. There are around forty individual projects for public, school, academic and tribal libraries. Overall, over two thousand requests were posted. Several hundred projects might actually receive funding.
