Hi Lynette,
If all goes well, we can set the rule after the public hearing. The rule will then have to be published in the NM Register. That should take it to the end of December or the beginning of 2022 before the new rule is official.
We do currently have an emergency rule for 4.5.9 in place that has a version of those three amendments that we were able to put into place on July 1 without a public hearing. It enables us to distribute the entirety of federal relief funds (such as ARPA funds), do an upfront disbursement of Senate Bill 377 funds to tribal libraries and a couple of other things. The emergency rule will expire at the end of December, however, if we don't go through the regular rule-making process to make the amendments permanent.
That may be more than you are asking, but it gives some context to why we are proposing to make the amendments now.

The State Library is seeking to amend the 4.5.9 NMAC "Special Grants to Public Libraries."
The proposed amendments seek to:
1) allow expanded eligibility for certain grants when so defined in grant guidelines,

The purpose of the hearing is to consider amending rule 4.5.9 NMAC, Special Grants for Public Libraries. The NMSL proposes to amend the rule in order to facilitate the effective administration of special grants for public libraries.
The statutory authority for the proposed changes to 4.5.9 NMAC is found in Subsection I of Section 18-2-4 NMSA 1978 which directs the state librarian to make rules and regulations necessary to administer the division and as provided by law and Subsection B of Section 18-2-4 NMSA 1978 which directs the state librarian to administer grants-in-aid and encourage local library services and generally promote an effective statewide library system. The NMSL is considering the adoption of a new rule 4.5.9 NMAC in order to allow full disbursement of federal funds awarded for emergency relief, expand grant eligibility through guidelines set by the state librarian, and allow the state librarian to determine through grant guidelines whether a grant award will be disbursed directly or by way of reimbursement.
